These
Terms and Conditions govern the rights and obligations between DEEP VISION s.r.o., with its registered office at Hlaváčova 207, 530 02 Pardubice, Company ID No.: 27540065, registered at the Regional Court in Hradec Králové, Section C, Insert 24949 (hereinafter referred to as the "Seller"), and by a person ordering goods through the ponplanet.eu e-shop  (hereinafter referred to as  the "Buyer").

These terms and conditions apply to purchase contracts concluded through the ponplanet.eu online store, both by legal entities and natural persons (consumers) – unless otherwise stated for operational or legislative reasons.

1. Introductory Provisions

1.1. The Seller operates an online store on the www.ponplanet.eu website.

1.2. If the Buyer orders goods as a consumer (i.e. a natural person who does not act within the scope of his/her business activity), the provisions relating to consumer protection pursuant to Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection, also apply to the Buyer.

1.3. The Buyer is obliged to follow these Terms and Conditions when registering as a user and when ordering goods. By ordering the goods, the Buyer agrees to these terms and conditions.

1.4. The Seller reserves the right to change these Terms and Conditions at any time. The version valid at the time of concluding the purchase contract is binding on both parties.

2. User Account and Registration

2.1. The Buyer has the option to register a user account. By registering, the Buyer gains access to order management, purchase history, possible benefits.

2.2. When registering, the Buyer provides true and up-to-date information and is obliged to update them in the event of a change.

2.3. Access to the account is protected by a password – the Buyer is obliged to keep it secret and not to allow its use by other persons.

2.4. The Seller may cancel the account in the event of a serious breach of the Terms.


 

3. Order and conclusion of the contract

3.1. The order can be placed via the web interface of the store.

3.2. The Purchase Contract is concluded at the moment when the Seller sends the Buyer  an order confirmation to the e-mail address specified in the order.

3.3. The Buyer has the option to check and modify the contents of the order before sending it.

3.4. Information about the price of the goods, brand, features, availability must be identical on the product page and in the feed to what is stated in the order.

4. Price, Payment and Currency

4.1. Product prices include VAT, in CZK.

4.2. The Seller accepts the following payment methods:

  • cash on delivery;

  • cash payment on delivery;

  • Payment by invoice.

4.3. When paying during the order or cash on delivery, the Buyer shall also pay the costs associated with packaging and delivery, if these costs are not already included.

4.4. The Seller is a VAT payer and issues a tax document/invoice to the Buyer in accordance with the applicable legislation.

5. Delivery / Shipping

5.1. Shipping methods, carriers and costs are listed in the e-shop before completing the order.

5.2. The delivery time for goods in stock is usually within 2 working days (as is now stated for items in stock). For goods that are not in stock, the buyer will be informed of the deadline individually.

5.3. The Buyer is obliged to inspect the packaging upon receipt of the goods – if he finds damage, he immediately notifies the carrier and the Seller.

5.4. In the event that the Buyer requests a method of transport other than the standard one (e.g. a designated place, outside the standard route), the Buyer bears the costs and possible risks associated with this method of transport.

6. Withdrawal (for consumers)

6.1. The Consumer has the right to withdraw from the contract within 14 days of receiving the goods, without giving a reason.

6.2. The period begins to run from the date on which the Buyer has taken over the goods.

6.3. Withdrawal must be notified in writing (by e-mail or by post) to the address: obchod@deepvision.cz or [postal address].

6.4. In the notification, the Buyer indicates: name, address, order number, goods he wants to return, date of receipt.

6.5. The cost of return shall be borne by the Buyer, unless otherwise stipulated by law or otherwise stated in the Transport Conditions.

6.6. The Seller shall refund the money back to the account provided by the Buyer within 14 days of receiving the returned goods.

7. Complaints and defective performance

7.1. The Seller is responsible for defects in the goods upon receipt – the goods must be free of defects that would limit their functionality or usability.

7.2. The Buyer is obliged to file a complaint without undue delay after discovering the defect, in writing or via the contact form or e-mail (contact: obchod@deepvision.cz).

7.3. In the event of a complaint, the Buyer shall provide: a description of the defect, proof of purchase, photographs of the defect, if any.

7.4. The warranty period is according to legal regulations – for consumers usually at least 24 months, unless otherwise stated for the goods.

7.5. The Seller shall settle the complaint without undue delay, no later than within 30 days, unless otherwise stipulated by law.

8. Ownership and risk

8.1. Ownership of the goods shall pass to the Buyer on the day on which the goods are fully paid for by the Buyer.

8.2. The risk of damage to the items passes to the Buyer upon receipt of the goods from the carrier or upon personal collection.

9. Privacy and cookies

9.1. The Seller is the administrator of personal data: DEEP VISION s.r.o.

9.2. Data processing is governed by the GDPR (EU Regulation 2016/679) and the relevant Czech laws.

9.3. The following data is collected: name, address, e-mail, telephone, delivery address, basic delivery and billing data.

9.4. The data are used for the performance of the contract, the issuance of documents, communication with the Customer, possible marketing purposes (if the Buyer has given consent).

9.5. The Buyer has the right to access the data, rectification, erasure, restriction of processing, portability, to lodge a complaint with the Office for Personal Data Protection.

9.6. Cookies: the website uses cookies for operation, analysis and (with explicit consent) marketing purposes. The buyer can withdraw the consent and change the cookie settings.

10. Governing Law and Dispute Resolution

10.1. Legal relations are governed by the laws of the Czech Republic.

10.2. If the Purchase Agreement includes an international element, the parties agree that the law of the Czech Republic is applicable.

10.3. The Buyer has the right to contact the Czech Trade Inspection Authority or other consumer protection institutions.

11. Effectiveness

These Terms and Conditions come into force on 16.8.2022.
